           In the event you become unable to make coherent choices, you will need to appoint someone to intervene on your behalf. Without a comprehensive incapacity plan, a judge can appoint an agent (known as a guardian or a conservator) to take control of your assets and make all personal and medical decisions for you under a court-supervised guardianship or conservatorship.  The guardian or conservator must report all financial transactions to the court either on an annual basis or at least every few years. The guardian or conservator is also typically required to obtain court permission before entering into certain types of financial transactions (such as mortgaging or selling your real estate) or making life-sustaining or life-ending medical decisions. The court-supervised guardianship or conservatorship will then continue until you either regain capacity or die. 
            &#xD;

    &lt;li&gt;&#xD;

            How organized is the agent? The agent will need to be well organized to manage your health care needs, keep track of your assets, pay your bills, balance your checkbook and manage their own finances and family obligations.

In the typical situation, you will be the trustmaker, the trustee, and the beneficiary of your own revocable living trust. A second concrete step you can take to ensure the welfare of your family is to pull out your estate planning documents and take a close look to verify that they still reflect your wishes and are able to accomplish your goals.

           still achieve your goals? In your will, you have specified how you want your money and property distributed to the beneficiaries you have chosen.  Additionally, if you have children, you probably named a guardian in your will or a document to care for them if you cannot. If you have a revocable living trust, you likely named a trusted person to be your co-trustee or successor trustee to step in to manage the money and property held in the trust during your lifetime in case you become incapacitated or unable to do it yourself. Also, you specified how the money and property in the trust should be distributed to beneficiaries named in the trust document once you pass away.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;

           Life is constantly changing, so it is important to review not only the people you have named as beneficiaries, but also to consider whether the people you named to act as your executor or trustee are still your top choices. Even if you are still comfortable with your previous choices, are the individuals you selected currently available to act in those roles? Is the person you chose to be the guardian of your children still available and willing to care for them? If several years have passed since you drafted your documents, your executor or trustee may have moved away or may otherwise be unwilling or unable to serve. In the current crisis, the person you have selected may be unavailable due to illness, quarantine, or a stay-at-home order, and if he or she lives out of state, may be subject to travel restrictions.

          Now that you have made an appointment with us, you are probably wondering what to bring to your appointment. We have compiled a list below of what you will want to bring to help move the estate planning process as quickly and efficiently as possible.

          We will also be asking some in-depth questions about you: your finances, your goals, your family, and of course any questions and concerns you may have. Once we have that documentation and information in front of us, we will work on designing your custom estate plan and set a follow-up appointment to have you come back and sign your estate planning documents when they are ready.
         &#xD;

                    Think back to the last time you went to the doctor’s office. It could have been a routine blood test, an annual physical, a quick checkup – any number of things. Did your doctor ask you to sign anything, or ask whom they could contact and provide with information about your results? There is a reason they ask that: the Health Insurance Portability and Accountability Act (HIPAA).
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    HIPAA regulates the use and disclosure of protected health information concerning a patient and makes it so that no one other than you can receive information about yourself. This is a very useful federal regulation that helps to protect your confidential health information. This way, no one but you can call up your doctor or hospital and request your information. This keeps your private records secure, as well as your personal information. Nobody likes having their privacy violated, and HIPAA helps protect that.

                    What will you do in the event that you become incapacitated? Perhaps you have an accident resulting in a coma. However, when they go to retrieve your medical records, they will be asked whether they are HIPAA authorized to view your information. If they are, then they will receive it and be able to make a better decision on your behalf. If they are not (and it will be checked), then they are in no way going to see that information. That can be a problem to both you and your estate.

                    While HIPAA is beneficial to everyone, it does create a bit of a roadblock for your family and your estate if you get sick, injured, or incapacitated without having a HIPAA Authorization filled out and ready.
